ACKNOWLEDGMENT OF RISKS, ASSUMPTION OF RISK AND RESPONSIBILITY, AND RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS PLEASE READ CAREFULLY BEFORE BOOKING.

THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS. I have been provided the opportunity to participate in Sauna At The Farm which includes the entire sauna, hot tub and bar area (the “Sauna”) and hereby voluntarily agree as follows:

SAUNA AT THE FARM TERMS AND CONDITIONS OF BOOKING

1. Bookings and Refunds
1.1 Bookings made on the website are processed via Paypal.
1.2 You do not need to have a Paypal account in order to make payments via the website, you can use the system as a guest.
1.3 You are not entitled to a refund on any booking that you cancel. The Company may offer a change of date if requested within 7 days of your booking.
1.4 A refundable deposit of £50 will be added to every booking to cover costs of damages. This deposit may not be refunded if:
1.4.a. Any damage is caused to the sauna area or fitness at the farm site or property during your stay.
1.4.b. If you stay beyond your allotted time as booked and stated in your confirmation email.
1.4.c. If the conditions of your stay are met, you will receive a £50 refund of deposit within 7 days of your stay.
1.5 If The Company cancels an order or booking you are entitled to a refund.

SAUNA AT THE FARM RULES:

• Anyone using the sauna or hot tub must be over the age of 16
• 6 people max in the sauna or hot tub at any time.
• Do not bring glass in any form in to the entire Sauna area.
• No nudity in the Sauna area.
• No food or drink should be taken in to the sauna or hot tub. There are plastic glasses for your use on the site.
• You may not use the sauna or hot tub if you are pregnant or have a medical condition which would be made worse by extreme heat.

ACKNOWLEDGEMENT OF RISKS

My participation in the sauna involves known and unknown risks, dangers, and hazards that may cause death, personal injury, damage to personal property and loss of personal property. The risks and consequences I am acknowledging include, but are not limited to those stated in the Sauna At The Farm risk assessment available on site.

These risks include but are not limited to:

• Exposure to hot and cold temperatures
• Risk of slips and falls due to wet surfaces, weather conditions, uneven ground and other conditions
• Risk of burns from hot equipment including wood burners in the sauna and hot tub, fire pits and ovens
• Changes to physical state due to sauna and hot tub heat or cold plunges
• Defects in build of the facilities including but not limited to: hot and cold showers, changing facilities, bar area, sauna and hot tub
• The effects of sun exposure and other severe weather conditions
• Risks from insects in the air or on the ground
• Other foreseeable and unforeseeable risks that contribute to the unpredictability of my participation in the Sauna.

I certify that I am physically fit for participation in this activity and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity. I acknowledge that this Accident Waiver and Release of Liability Agreement will be used by the event holders and organisers of the activity in which I and/or any children, pets or property under my guardianship, may participate, and that it will govern my actions and responsibilities at said activity.

REPRESENTATION OF FITNESS:

• I am over the age of 16
• I am physically and mentally fit to participate in the Sauna. I do not have any medical condition, such as anhidrosis, that interferes with my ability to sweat.
• I am not pregnant and am not subjecting a foetus to excessive body temperatures that may cause foetal damage during pregnancy.
• I am not taking or under the influence of any drugs, alcohol, medication, or other substance affecting my mental or physical state.
• I do not have a skin condition that could be considered contagious, e.g. scabies.
• I do not have an unstable heart condition (e.g. angina) or poorly controlled blood pressure that could be affected by exposure to extreme heat.
• I am not experiencing any symptoms of COVID-19 at the time of use. I have NOT had recent onset of any of the following: • a new continuous cough • a high temperature • a loss of, or change in, your normal sense of taste or smell (anosmia)

I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: Leah Maclean, At The Farm, Collins Farm directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers;

I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

I acknowledge that Leah Maclean or anyone associated with At The Farm and Collins Farm is NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. I acknowledge that this activity may involve a test of a person’s physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity.

These risks are not only inherent to participants, but are also present for volunteers. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organisers, and assigns.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

By booking any product or service via the FARM-FIT.CO.UK website I am accepting these Terms & Conditions and I certify that I have read this document and I fully understand its content. I am aware that this is a release of liability and a contract and I agree to it of my own free will.
